SKULabs Privacy Policy

SKULabs is committed to maintaining robust privacy protections for its Users. Our Privacy Policy is designed to help you understand how we collect, use and safeguard the information you provide to us and to assist you in making informed decisions when using our Service.

For purposes of this Agreement, “Service” refers to SKULabs’s service which can be accessed via our website at SKULabs.com, in which Users can manage warehouse inventory and fulfill orders from connected electronic commerce platforms. The terms “we,” “us,” and “our” refer to SKULabs. “You” refers to you, as a User of Service. By accepting our Privacy Policy and Terms of Use (found here: www.skulabs.com/terms-of-use), you consent to our collection, storage, use and disclosure of your personal information as described in this Privacy Policy.

Information We Collect and Receive

SKULabs may collect and receive Personal Information and other information and data (“Other Information”) in a variety of ways:

  1. Personal Information. Users or individuals granted access to SKULabs by a User routinely submit Personal Information to SKULabs when using our Service.
  2. Other Information. SKULabs also collects, generations and/or receives Other Information including:
    1. Company Information. To create or update a SKULabs account, you or your Users supply SKULabs with an email address, phone number, password, company address and/or similar company details.
    2. Billing Information. Users that purchase a paid subscription for the Service provides SKULabs (or its payment processors) with billing details such as credit card information, banking information and/or a billing address. If a credit card is submitted, the full card number will not be visible to SKULabs or stored on its servers pursuant to PCI DSS compliance regulations. The billing address submitted will only be used to verify authorized use of the card, and will not be used for any other purposes by SKULabs or third parties.
    3. Usage Information. As with most websites and technology services delivered over the Internet, our servers automatically collect information when you access or use our Site or Service. This information may include your Internet Protocol (IP) address, your browser type and settings, the web address visited before you arrived at our Site, and the date and time the Service was used.
    4. Cookie Data. “Cookies” are data files that are placed on your device or computer and often include an anonymous unique identifier. For more information about cookies, and how to disable cookies, visit allaboutcookies.org.
    5. Third Party Services. A User can choose to permit or restrict Third Party Services for their account. Typically, Third Party Services are software that our Service communicates with on behalf of the User. Once enabled, the provider of a Third Party Service may share certain information with SKULabs. Users should check the privacy settings and notices in these Third Party Services to understand what data may be disclosed to SKULabs. When a Third Party Service is enabled, SKULabs is authorized to connect and access Other Information made available to SKULabs in accordance with our agreement with the Third Party Provider.

Generally, no one is under any obligation to provide any Personal Information or Other Information. However, certain Information is collected automatically and, if some Information, such as Company Information and Billing Information, is not provided, we may be unable to provide the Service.

How We Use and Share Information

User Information will be used by SKULabs in accordance with our User’s instructions, including any applicable terms in the User Agreement and User’s use of Service functionality, and as required by applicable law. SKULabs is a processor of User Information and the User is the controller. A User may, for example, use the Service to grant and remove access to a team, assign roles and configure settings, access, modify, export, share and remove User Information and otherwise apply its policies to the Service.

SKULabs uses Other Information in furtherance of our legitimate interests in operating our Service, Site and business. More specifically, SKULabs uses Personal Information:

  1. To provide, update, maintain and protect our Services, Websites and business,
  2. As required by applicable law, legal process or regulation,
  3. To communicate with you by responding to your requests, comments and questions,
  4. To develop and provide search, learning and productivity tools and additional features,
  5. To send emails and other communications,
  6. For billing, account management and other administrative matters,
  7. To investigate and help prevent security issues and abuse.

If Information is aggregated or de-identified to the point which it is no longer reasonably associated with an identified or identifiable natural person, SKULabs may use it for any business purpose. To the extent Information is associated with an identified or identifiable natural person and is protected as personal data under applicable data protection law, it is referred to in this Privacy Policy as “Personal Information”.

Data Retention Time

Information is kept for the time necessary to provide the service requested by the User, as stated by the purposes outlined in this document. You can always contact the Data Controller for suspension or removal of Personal Information.

Data Controlled By Our Users

For the purposes of providing the Service to our Users, SKULabs collects personally identifiable information provided by the User through automated integrations, syncs, imports, or through manual submissions. Neither SKULabs nor our Users have a direct relationship with the individuals whose personal data is processed by SKULabs.

If you are a customer of one of our Users and wish to remove your personally identifable information from our Service, please contact the User that you interact with directly. For the purposes of providing the Service, SKULabs may transfer personally identifiable information to companies that help provide the Service. Transfers to subsequent third parties are covered by the service agreements with our Users.

Access & Retention of Data Controlled by Our Users

SKULabs acknowledges that you have the right to access your personally identifiable information. An individual who seeks to access, correct, amend, or delete inaccurate data should direct their query to SKULabs’s User (the data controller). If SKULabs is requested to remove personally identifiable information, we will respond within a reasonable timeframe.

SKULabs will retain personally identifiable information as needed to provide the Service. Once your relationship with SKULabs is terminated, SKULabs will delete any personally identifiable information we hold within a period of 90 days from the date of termination. Further, personally identifiable information that was submitted with a sales order will be deleted within 30 days of the complete fulfillment of that order by the User responsible for the order.

How We Protect Information

In the unlikely event of a breach of data which results in a risk for the rights and freedoms of either our Users or their Customers, we will notify our Users within 72 hours of first becoming aware of the breach.

Data Controller and Owner

Data protection laws in certain jurisdictions make a distinction between the “controller” and the “processor” of Information. In general, the User is the controller of Personal Information, while SKULabs is the processor of Personal Information and Other Information. SKULabs, LLC is a US company based in Florida.

Your Rights Regarding Personal Information

Our Privacy Policy explains how you may access and/or submit requests to review, correct, update, suppress, or delete Personal Information. You can ask to review and correct Personal Information that we hold by sending a written request to privacy@skulabs.com. We may limit or deny access to Personal Information where providing such access is unreasonably burdensome, expensive under the circumstances, or as otherwise permitted by the GDPR and other regulations that apply.

When we act on behalf of our Users, we will assist Users in responding to individuals exercising their rights under GDPR and other regulations that apply.

If you are a Customer of a User, please contact the User directly with your request to access or limit the use or disclosure of your Personal Information. If you contact us with the name of the User to which you provided your Personal Information, we will refer your request to that User and support them in responding to your access request.

SKULabs as a Data Processor

We may collect, use and disclose certain Personal Information about Customers when acting as the User’s service provider. Our Users are responsible for making sure that the Customer’s privacy rights are respected, including ensuring appropriate disclosures about third party data collection and use. To the extent that we are acting as a User’s data processor, we will process Personal Information in accordance with the terms of our agreement with the User and the User’s lawful instructions.

Links to Other Websites

As part of the Service, we may provide links to or compatibility with other websites or applications. However, we are not responsible for the privacy practices employed by those websites or the information or content they contain. This Privacy Policy applies solely to information collected by us through the Site and the Service. Therefore, this Privacy Policy does not apply to your use of a third party website accessed by selecting a link on our Site or via our Service. To the extent that you access or use the Service through or on another website or application, then the privacy policy of that other website or application will apply to your access or use of that site or application. We encourage our Users to read the privacy statements of other websites before proceeding to use them.

Changes to This Privacy Policy

SKULabs reserves the right to change this policy and our Terms of Use at any time. We will notify you of significant changes to our Privacy Policy by sending a notice to the primary email address specified in your Account or by placing a prominent notice on our site. Non-material changes or clarifications may take effect immediately and without notification. We encourage you to periodically check the Site and this privacy page for updates.

Addendums to This Privacy Policy

GDPR Data Processing Addendum: If you are a resident of the European Union (“EU”), European Economic Area (“EEA”), Switzerland or the United Kingdom, you are subject to additional policies and protections in compliance with the European Union’s General Data Protection Regulation (“GDPR”).
